The warning comes at a crucial stage as intense discussions continue among political parties following the declaration of results. TVK leaders have argued that the party deserves the first opportunity to form the government because it secured the highest number of seats in the Assembly. However, Governor RV Arlekar has reportedly declined to invite Vijay to stake claim immediately, citing the absence of a clear majority.
Dispute Over Majority Numbers
According to reports, TVK has informed the Governor that it has secured the backing of 113 legislators, including support from members of the Congress party. Despite this, the Governor is believed to have insisted that the party demonstrate support from at least 118 MLAs before any invitation to form the government can be issued.
Sources close to the party claim Vijay is prepared to establish his majority during a floor test in the Assembly. The disagreement has intensified the political atmosphere in the state, with both the Dravida Munnetra Kazhagam (DMK) and the All India Anna Dravida Munnetra Kazhagam (AIADMK) closely monitoring developments.

The ongoing standoff has also sparked discussions among constitutional experts and senior legal professionals. Several experts have referred to the Supreme Court’s judgment in the SR Bommai vs Union of India case, which established that a legislative majority should be tested on the floor of the Assembly rather than being decided solely through the Governor’s assessment.
Legal analysts believe the present situation could become an important constitutional issue if the deadlock continues. Questions are now being raised over whether the Governor should permit a floor test before exploring alternative government formation options.

Senior legal experts have indicated that if TVK fails to form the government, rival parties may explore coalition arrangements. Discussions around a potential alliance involving the AIADMK and the DMK have gained attention as political parties evaluate all available options to secure a working majority in the Assembly.

Mass Resignation Could Trigger Bypolls
If TVK legislators resign collectively and those resignations are formally accepted, the state may face a large number of vacant Assembly seats. Legal experts have stated that by-elections would likely be required for all 108 constituencies represented by TVK lawmakers.
Conducting bypolls on such a massive scale could create a prolonged period of political uncertainty in Tamil Nadu. Election authorities would also face logistical and administrative challenges in organizing voting across so many constituencies within a limited period.
What Happens If No Government Is Formed
Experts have also explained that if no political party or alliance succeeds in proving a majority, the Assembly may eventually be dissolved. In such a scenario, the state could move toward fresh elections. Until a new government is formed, President’s Rule may be imposed as an interim constitutional measure.
